Ebay fined $61m by french court for sales of fake goods

A court in France ordered eBay to pay more than 61 mega-dollars to the parent company (LVMH) of Givenchy, Fendi, Marc Jacobs and Louis Vuitton, because a user sold fake goods on the website. eBay has been sued by other 'luxury goods' vendors (such as Tiffany's (US), Rolex (Germany) and L'Oreal (EU)). Problems stem from some companies demanding that their merchandise (even legal merchandise) not be displayed nor sold as it is a violation of their 'property.' Others have complained that eBay is too slow to take down claims. Apparently eBay was hit with two violations: 1) eBay illegally allowed legitimately purchased and owned products made by LVMH to be resold on its website by 3rd parties not under the control of LVMH, and 2) not doing enough to protect LVMH's brands from illegal sales. eBay has said it will appeal. So eBay is to know what products every company allows to be sold before allowing them to on auction? (There's also coverage at Yahoo News.) Nasa launches satellite to monitor oceans

On Friday, NASA launched the Ocean Surface Topography Mission/Jason 2 satellite into orbit to begin a detailed study of ocean currents, sea-surface height, and surface topology. Scientists hope to use the data gathered by Jason 2 in order to better understand weather patterns and global warming. Further details about the mission objectives (PDF) are also available. Quoting NASA's press release: "Combining ocean current and heat storage data is key to understanding global climate variations. OSTM/Jason 2's expected lifetime of at least three years will extend into the next decade the continuous record of these data started in 1992 by NASA and the French space agency Centre National d'Etudes Spatiales, or CNES, with the TOPEX/Poseidon mission. The data collection was continued by the two agencies on Jason 1 in 2001. Compared with Jason 1 measurements, OSTM/Jason 2 will have substantially increased accuracy and provide data to within 25 kilometers (15 miles) of coastlines, nearly 50 percent closer to shore than in the past."

According to timesonline.co.uk, a new measure approved yesterday by the French Cabinet would kill the Internet connection to those caught downloading illegally. 'There is no reason that the internet should be a lawless zone," President Sarkozy told his Cabinet yesterday as it endorsed the "three-strikes-and-you're-out" scheme that from next January will hit illegal downloaders where it hurts. Under a cross-industry agreement, internet service providers (ISPs) must cut off access for up to a year for third-time offenders.' Google and video site Dailymotion have refused to sign up as consenting participants, and the state data protection agency, consumer and civil liberties groups and the European Parliament are all kicking against the goad as well. France may be pioneer in this kind of legislation, but they sure have their work cut out for them."

How to clean up incorrect geolocation information?

zorro6 writes "I thought this might be an interesting question/topic and it would sure help me to get some kind of answer. I recently got internet service from a small, local wireless ISP in my area (south central Colorado, USA). The strange thing is that many, many web sites think I am in Quebec, Canada when I use the service. Evidently some geolocation service thinks my IP address indicates I am in Canada. I have checked the obvious. The WHOIS information for my IP correctly indicates a location of Durango, CO. So the bad info is coming from some more sophisticated geolocation service. My ISP is at a loss as to how to fix this but it is causing me a lot of grief. Many of the ads I get shown on Yahoo! for instance are in French! Certain sites won't sell me goods or services because they don't do business in Canada. So far I know that Yahoo! (or their ad provider), Nvidia, Movielink, etc. all think I am in Canada. I would sure appreciate any help/info on how to get this corrected."

Corrupt links to a Sydney Morning Herald article which begins "The French state and internet service providers have struck a deal to block sites carrying child pornography or content linked to terrorism or racial hatred, Interior Minister Michel Alliot-Marie announced on Tuesday." The article is thin on details, but what it does say is bad enough: "Under the French plan, internet users, via a platform, will be able to signal inappropriate sites and the state, receiving the complaints in real time, will then decide whether the sites are to go on a so-called black list to be passed on to internet service providers to enforce site blocks." It sounds like the perfect way to organize an especially malicious DDoS attack. The French government has never been shy about wanting to "protect" French people by censoring Internet content, though.

Jm_aus writes "eBay's plan to force all users to use PayPal only has been rejected by Australia's competition regulator, the ACCC. This followed 650 submissions from eBay users as well as from Australian banks, other payment services, the Australian Reserve Bank, and (anonymously) Google, which aired a lot of dirty laundry about PayPal's unresponsiveness and failure to sign up to the local banking code of conduct. Apparently the public benefits from eBay's 'Bad Buyer Experience' elimination program are likely to be 'minimal.' There is a period for appeals."

Although only 0.8 times the radius of Jupiter, it is over 20 times as massive, giving it a density twice that of the metal platinum. If it is a star, it would be the smallest of those ever discovered."

doppiodave writes "Hard on the heels of the Net Neutrality bill introduced in Canada's Parliament, a class action suit was filed yesterday against Bell by Quebec's Consumers Union, asking that extensive compensation be paid to all Bell's DSL subscribers for fraudulent advertising and privacy violations. The press release is available in French. The timing of this suit coincides with several other developments that suggest Net Neutrality is finally coming to the attention of the general public and Canada's regulator, the CRTC, which recently required Bell to file responses (by May 29) to an exhaustive list of interrogatories about its traffic-shaping practices."

Almost six years ago, we talked about the story of Michel Fournier, a retired French army officer who planned to skydive from a height of 25 miles. That plan and a subsequent attempt one year later both failed due to "technical and weather-related problems." Now, at the age of 64, Fournier is set to try again. If everything goes right, his speed will approach 1,000 miles per hour during the early stages of his 15-minute descent. Quoting the NYTimes: "Fournier faces plenty of perils. Above 40,000 feet, there is not enough oxygen to breathe in the frigid air. He could experience a fatal embolism. And 12 miles up, should his protective systems fail, his blood could begin to boil because of the air pressure, said Henri Marotte, a professor of physiology at the University of Paris and a member of Fournier's team. 'If the human body were exposed at very high altitude, the loss of consciousness is very fast, in five seconds,' Marotte said. 'Brain damage, in three or four minutes.'"

Racketiciel writes "A French user asked for a refund after buying an ASUS computer that came with Windows XP and other software pre-installed. ASUS tried to apply a procedure which cost more money to the consumer than they will give back... The court ruled in favor of the user, who received back 130 Euro (~200 $) for the software. Here is the ruling (PDF, French). In France, this is the fourth victory for refund seekers during the last two years, and many people are now filing for refunds (in French). Two French associations (AFUL and April) published a press release on this victory the same day an important hearing happened." The English-language press release linked above gives a pretty good idea of what happened here, for those unsuited to wading through French.
