Open source business model using software patents

Joe Barr writes "Robin Miller has an exclusive video interview with Larry Rosen and Fred Popowich this morning on Linux.com about their new open source business model which includes software patents in its DNA. Their motto is 'Free for open source, everyone else pays.' Larry Rosen was once legal counsel for the OSI." Linux.com and Slashdot share a corporate parent.

Researchers create a protein map of human spit

Ant writes "United States researchers have identified all 1,116 unique proteins found in human saliva glands. It was a discovery they said on Tuesday that could usher in a wave of convenient, spit-based diagnostic tests that could be done without the need for a single drop of blood. As many as 20 percent of the proteins found in saliva are also found in blood, said Fred Hagen, a researcher at the University of Rochester Medical Center in New York who worked on the study."

Microsoft to give away developer tools to students

beuges writes "The Associated Press is reporting that Microsoft will make full versions of their development tools available to students. "The Redmond-based software maker said late Monday it will let students download Visual Studio Professional Edition, a software development environment; Expression Studio, which includes graphic design and Web site and hybrid Web-desktop programming tools; and XNA Game Studio 2.0, a video game development program. Gates said students will want to try Microsoft's tools because they're more powerful than the open-source combination of Linux-based operating systems, the Apache Web server, the MySQL database and the PHP scripting language used to make complex Web sites. But Gates said giving away Microsoft software isn't intended to turn students against open source software entirely. Rather, he hopes it will just add one more tool to their belt.""

Writer's guild nominates game writing

Ars Technica's Opposable Thumbs blog notes that the Writer's Guild of America stepped back from the picket line long enough to nominate a few 2007 games for great writing. Unfortunately, their nominees suck. The list of nominees consists of: "Crash of the Titans, Written by Christopher Mitchell, Sierra Entertainment. Dead Head Fred, Written by Dave Ellis and Adam Cogan, D3 Publisher. The Simpsons Game, Lead Writer Matt Selman, Written by Tim Long and Matt Warburton, Dialogue by Jeff Poliquin, Electronic Arts. The Witcher, Lead Story Designer Artur Ganszyniec, Dialogue Sebastian Stepien, Additional Dialogue Marcin Blacha, Writers Sande Chen and Anne Toole, Atari. World in Conflict, Story Design Christofer Emgard, Story Consultant Larry Bond, Script Consultant Ed Zuckerman, Sierra Entertainment." No Mass Effect? Nothing at all from the Orange Box? No BioShock? For shame, WGA.

David x. cohen of futurama talks about the movie

Joel Keller writes "I conducted a brief interview with David X. Cohen, EP and show-runner for Futurama, about the release of the new DVD, "Futurama: Bender's Big Score," as well as the return of his show to TV. The interview was posted to TV Squad this morning. In it, Cohen talks about how the movies will be split up into episodes, some of the inside references that they inserted for the die-hards, and a quick preview of what the second Futurama movie is going to be about."

Censoring maniac mansion for the nes

Via Destructoid, an article at the personal site of Douglas Crockford, a gent who worked with LucasArts during the NES days. He takes a look at the silly amount of content censored to get the game Maniac Mansion acceptable for Nintendo and the Nintendo Entertainment System. "'Well, Mommy, I'm worried! He hasn't eaten in 5 years. / YEAH, SO!!! / and he's been bringing those bodies, and he carries those bodies to the basement at night.' [sic] This was from Weird Ed's dialogue with his mother, Nurse Edna, in which Ed tries to get his mother to recognize the terrible things that have happened to his father over the past 20 years. What was Nintendo's problem with the dialogue? ... In fact, Nintendo's interpretation of the speech was that Dr. Fred was a cannibal, that he was eating the bodies. That was never our intention, so we changed Ed's speech to 'He hasn't slept in 5 years,' which helps to explain why Dr. Fred is never seen in his bedroom. But even if we had intended that Dr. Fred was a cannibal, what's the harm? He would have been one under the influence of the evil purple meteor. The game recognizes that it is bad, and your mission is to rescue him from this unhappy state. Who would be offended?"

Volcanoes may have caused mass extinctions?

Hugh Pickens writes "According to recent research, huge amounts of sulphur dioxide released by volcanic eruptions may have had more to do with wiping out dinosaurs than the meteorite strike at Chicxulub on Mexico's Yucatán Peninsula. Marine sediments drilled from the Chicxulub crater have revealed that that the mass extinctions occurred 300,000 years after Chicxulub hit Earth. The Deccan volcanism was a long cumulative process that released vast amounts of greenhouse gases into the atmosphere. '"On land it must have been 7-8 degrees warmer," says Princeton University paleontologist Gerta Keller. "The Chicxulub impact alone could not have caused the mass extinction, because this impact predates the mass extinction."' Keller also postulates a second larger and still unidentified meteor strike after Chicxulub, that left the famous extraterrestrial layer of iridium found in rocks worldwide and pushed earth's ecosystem over the brink. But where's the crater? "I wish I knew," says Keller."

Epic's motion to dismiss sk suit denied

The ongoing saga of the suit/counter-suit battle between Epic Systems and Silicon Knights continues, with Epic's motion to dismiss dismissed. GameDaily reports: "GameDaily BIZ briefly spoke with SK's attorney on the case, Christopher T. Holland, an Equity Partner at Krieg, Keller, Sloan, Reilley & Roman, LLP. Holland confirmed to us that all of SK's initial claims will not be thrown out and 'remain in play for the trial.' An exact date for the trial has yet to be set. 'We're a long way from a verdict in this case, but certainly as a plaintiff we're pleased that the court has recognized the merit in our claims and we're happy that we can now proceed as planned with all the claims we brought for discovery and trial,' Holland said."

Comcast may face lawsuits over bittorrent filtering

An anonymous reader writes "It's been widely reported that Comcast is engaged in a sneaky form of Internet filtering. The company is terminating its customers' BitTorrent sessions by sending misleading data onto the network. The end result is that instead of targeting key heavy users, Comcast is instead engaged in an all out war against P2P protocols. In an interview with CNET, the Electronic Frontier Foundation's Fred von Lohmann states that Comcast is 'throwing a spanner in the works of the Internet, hoping that this will somehow reduce bandwidth usage overall.' Other lawyers seem to have smelled blood, and are circling in the water. Lohmann reveals that '[The EFF has] already been contacted by attorneys who are considering legal action against Comcast.' Could Comcast be facing a class-action?"

Usenet.com may find safe harbor from riaa lawsuit

Daneal writes "Ars Technica has some interesting analysis of the RIAA's lawsuit against Usenet.com. There's reason to believe that Usenet.com — and most other Usenet providers — could qualify for protection under the DMCA's Safe Harbor provision. 'The DMCA's Safe Harbor provision provides protection for ISPs from copyright infringement lawsuits as long as they take down offending material once they are served with a notice of infringement. "Whether the Safe Harbor applies is the central legal question that is going to be raised," EFF senior staff attorney Fred von Lohmann told Ars. An RIAA spokesperson tells Ars that the group has issued "many" takedown notices to Usenet.com, but von Lohmann says that the volume of takedown notices isn't what counts. "The DMCA's Safe Harbor makes it very clear," von Lohmann said. "The number of notices doesn't matter as long as you take the infringing content down."'"
