Although I'm not sure the corporate overlords will let me retroactively expense a movie ticket, I wanted to take a few minutes to write my review of Hellboy II. It's been a pretty good summer for movies already: but Wall-E and Iron Man were pretty much perfect A movies. I was a big fan of the original Hellboy comic, the first movie, and of Pan's Labyrinth- my fear was that it could only go downhill. And I was wrong. VERY wrong. Read on for my review which will be mostly spoiler free.

We learned today from court papers filed in North Carolina, in one of the cases targeting NC State students in Raleigh, that the North Carolina Private Protective Services Board has scheduled a Grievance Committee hearing to determine whether there is probable cause to investigate an alleged violation of the law by SafeNet (formerly known as MediaSentry). Fortunately for MediaSentry, they won't have to testify under oath, according to the notice (PDF)."

NewYorkCountryLawyer writes "After three years of pursuing a home health aide in Brooklyn who has never even used a computer, the RIAA has announced it's ready to throw in the towel. Only thing; it wants the dismissal to be 'without prejudice' so it won't be liable for attorney's fees. The courts have been saying that where a copyright plaintiff gives up, the defendant is presumptively entitled to an attorney's fee award. So, Ms. Lindor says 'no way.' She wants the dismissal to be 'with prejudice,' and she wants her attorney's fees." We've been discussing this case and Ms. Lindor's fight against the RIAA for quite some time.

Can't you just see Ballmer selling used cars on a local TV ad spot? Instead of running around a stage shouting: "Developers! Developers!" just visualize him running around a car lot shouting, "Cars! Cars!" I find it far too easy to do just that. This is the man who's going to replace Bill Gates? I don't think so. Besides, he already has a track record as acting head of the company, and it's lousy. Fire Ballmer now, why wait for him to fall on his face?"

I Don't Believe in Imaginary Property writes "A Brooklyn man has been found guilty of conspiracy to commit criminal copyright infringement by a federal jury in Virginia. He now faces up to five years in prison, a quarter-million-dollar fine, and three years of parole, not to mention the 'full restitution' he has to make to the RIAA. The charges against him stem from his role as 'Dextro,' the administrator of one of the Apocalypse Production Crew's file servers — APC being one of the release groups that specialize in pre-release music. While he's the 15th member of APC to be charged under the US DOJ's Operation Fastlink, he's the first to be convicted. He will be sentenced on August 8th. For those wondering when infringement became a criminal matter, you can thank the NET Act, which was signed into law in 1997 by Bill Clinton."

The issue at hand is whether the RIAA's investigator SafeNet (the company that acquired MediaSentry) now needs to disclose its digital files, validation methodology, testing procedures, failure rates, software manuals, protocols, packet logs, source code, and other materials, so that the validity of its methods can be evaluated by the defense. SafeNet and the RIAA say no, claiming that the information is 'proprietary and confidential'. Ms. Lindor says yes, if you're going to testify in federal court the other side has a right to test your evidence. A list of what is being sought (pdf) is available online. MediaSentry has produced 'none of the above'. 'Put up or shut up' says one commentator to SafeNet."

The San Francisco writing center called 826 Valencia works to teach kids passion for the written word. The program really works, and has expanded to other cities across the country in an effort to get more young people writing. To fund these outreach programs, the organization has opened some ... unique businesses in their new locales. The LA chapter, for example, features a Time Travel mart. The imaginative place features dozens of products like Robot Milk, Viking Oderant, and Olde Fashioned English Gunpowder. Other centers around the country offer similar themed experiences, like the NYC Brooklyn Superhero Supply Co. or Seattle's Greenwood Space Travel Supply Corporation."

NewYorkCountryLawyer writes "The RIAA's litigation campaign has met resistance from the academic community before, but now it's been taken to a whole new level: the defense of RIAA victims who are not part of the college community. First the University of Oregon lashed out on behalf of its students, then it was the University of Maine's Cumberland Legal Aid Clinic on behalf of its undergrads. Now, the University of San Francisco School of Law has taken the fight a giant step further. Its Intellectual Property Law Clinic's attorneys-in-training, working under the supervision of law professors, are going to bat against the RIAA by helping outside lawyers to defend their clients, pro bono. They reached out 3000 miles to get involved in Elektra v. Torres and Maverick v. Chowdhury, two cases going on in Brooklyn, NY, against non-college defendants. Two of the law students in the USF's legal program assisted in the research and preparation of briefs in these cases, opposing the RIAA's motion to dismiss the defendants' counterclaims. Thousands of honor students throughout United States law schools, most of them digital natives who actually understand the legal fallacies and technological missteps the RIAA is taking, and who can't wait to expose them, make a pretty good resource for the poor and middle class people trying to defend these cases."

Records, Interscope Records, Motown, and SONY BMG to disclose their expenses-per-download to the defendant's lawyers, in UMG v. Lindor, a case pending in Brooklyn. The Court held that the expense figures are relevant to the issue of whether the RIAA's attempt to recover damages of $750 or more per 99-cent song file, is an unconstitutional violation of due process."
